Recently, the Connecticut Office of Consumer Counsel (OCC) requested that the Connecticut Public Utilities Regulatory Authority direct Liberty to cease door-to-door sales and telemarketing to residential consumers, and to notify its existing Connecticut customers of Liberty’s rates and the standard rate consumers would otherwise be paying their local utility or electric distribution company (EDC).  The OCC alleges that Liberty’s telemarketing agents and door-to door field agents represent themselves to consumers as being from a utility company, and imply that consumers could avoid high rates on their existing utility bills by using Liberty as their energy supplier.  The end result is the misconception among consumers that Liberty is working with or on behalf of EDCs, and that consumers could obtain substantial savings by switching to Liberty.

Wittels McInturff Palikovic has filed multiple class actions against Eligo Energy, LLC and its affiliates, including Eligo Energy NY, LLC, Eligo Energy PA, LLC, and Eligo Energy OH, LLC, in federal court. These cases allege that Eligo charged customers unlawfully for inflated electricity and natural gas rates in violation of its own contracts.

The lawsuits allege that Eligo promises that its rates will be calculated according to certain defined terms, but instead imposes arbitrary and excessive charges, costing consumers millions more than they should have paid under the contracts they agreed to.

One customer alleges that, in 14 months since switching to Eligo, his family “paid over $2,500 more for Eligo gas than we would have paid . . . with no notification from Eligo that they were raising their price almost every month.” Another former customer, who says his rate “MORE THAN TRIPLED” after signing up with Eligo, states that “[i]t seems like this company exists for the purpose of tricking customers into massively overpaying for electricity. . . . So in summary, STAY AWAY FROM ELIGO ENERGY!” Warned one other: “Do not use this company. Their goal is to sign people on at an introductory rate and hope you forget about it so they can charge obscene amounts, over the legal limit allowed.” Yet another writes, “[m]y bill increased from less than $.07 [per unit] in November 2021 to over $.16 in February 2022 – more than double. . . .[T]his is customer abuse. With no recourse.”
