Wittels McInturff Palikovic is investigating a potential class action lawsuit involving Purple mattresses.  Purple makes mattresses that they claim compete with memory foam mattresses based on their patented Purple Grid technology.  The Purple or “GelFlex” Grid is a hyper-elastic polymer that is meant to provide a cushioned, supportive sleep experience.  But consumers have reported issues with Purple mattresses sagging or deteriorating over time.

These durability issues could cause discomfort by exposing the consumer to layers of the mattress below the GelFlex Grid.  Depending on the mattress type, this can lead consumers to feel the coils beneath the GelFlex Grid, which could not only disrupt sleep, but reduce comfort and support as well.  Purple claims that the GelFlex Grid “should never break down over time” because the material distributes weight and “helps lengthen the bed’s lifespan,” but consumers have reported that their mattresses become unusable in far less time than the advertised lifespan.  Some consumers report that the issues arise soon after the company’s touted “100-night trial” expires.  Consumers allege the mattresses are of “extremely poor quality,” complain of back pain and neck pain, call the company’s practices “deceptive,” and accuse the company of being a “scam” and “fraudsters.”
