Amazon Audible Auto Enrollment and Cancellation Investigation

Wittels McInturff Palikovic is investigating numerous complaints regarding Amazon’s potentially illegal practices of automatically enrolling customers in paid subscription plans for Audible after ostensibly free or low-cost trials and charging recurring payments without consumers’ consent.  Complaints also indicate that Amazon and Audible may make it difficult or confusing for users to cancel their automatically renewing memberships to prevent consumers from stopping payments.

Upon investigation, evidence suggests that Amazon may have lured consumers to purchase Amazon Prime subscriptions by offering a variety of benefits, one of which is “Free Titles at Audible.”  Audible, a subsidiary of Amazon, provides audio streaming and downloading for a monthly fee.  Amazon “invites” Prime members to start an Audible trial and provides “2 credits that can be used on any titles.”  But, instead of providing Amazon Audible free with Prime, consumers say Amazon enrolls Prime members into a paid Audible subscription.  WMP has already filed class actions against companies that have engaged in similar deceptive practices and may file similar lawsuits on behalf of Audible users unwittingly roped into unwanted paid memberships to recover unauthorized charges and other damages. 

Consumer complaints accuse Amazon and Audible of running a “scam” and call the charges for Audible “fraudulent.”  Consumers allege Amazon of “stealing money” from them.  Those consumers who are aware of the trial period say that Amazon makes it difficult to cancel the trial, even when seeking out videos showing how to cancel the service, and end up paying for Audible even though they never used or wanted it in the first place.
