Wittels McInturff Palikovic is investigating complaints from California consumers regarding SiriusXM’s potentially fraudulent practice of using consumers’ credit card or other payment information to automatically renew their subscriptions without consumers’ consent.

Upon investigation, evidence suggests that SiriusXM may have overcharged customers in California by automatically renewing their subscriptions at much higher rates than previously agreed upon.  Evidence also suggests that Sirius XM makes it unreasonably difficult to cancel a subscription or stop auto-renewal. WMP has already filed class actions against companies that have engaged in similar deceptive practices and may file similar lawsuits on behalf of California customers of SiriusXM to recover unauthorized charges and other damages. 

SiriusXM customers allege that they were not aware their account would automatically renew, that their recurring payments suddenly increase without notice or permission, and that SiriusXM re-subscribes or otherwise charges them without their knowledge after they cancel.  Consumers report that SiriusXM does not offer an option to cancel a subscription online. Furthermore, consumers say that when they do call to cancel they are subjected to high pressure sales tactics by customer service representatives trying to convince them not to cancel, which can result in spending an hour or more on the phone just to cancel a subscription.  As a result of these tactics, SiriusXM consumers accuse the company of “fraud” and say SiriusXM is a “scam,” “shady,” and “dishonest” with respect to its auto-renewal and cancellation practices.
