Obe Fitness California Auto Enrollment Investigation

Wittels McInturff Palikovic is investigating complaints from California consumers regarding Obé Fitness’s potentially fraudulent practice of using consumers’ credit card or other payment information to automatically convert their free trials or renew their subscriptions without consumers’ consent.

 

Upon investigation, evidence suggests that Obé Fitness may have lured customers in California into paid subscription plans unknowingly with misleading free trials.  Evidence also suggests that Obé Fitness makes it unreasonably difficult to cancel a trial, subscription, or autorenewal. WMP has already filed class actions against companies that have engaged in similar deceptive practices and may file similar lawsuits on behalf of California customers of Obé Fitness to recover unauthorized charges and other damages.

 

Although the startup Obé Fitness has attracted the attention of well-heeled investors and is reportedly valued at approximately $190 million, complaints about Obé paint a different picture.  Consumers describe Obé as a “predatory,” “misleading” and “tricky” “scam” with an “absolutely ridiculous” cancellation process and a “complete lack of care for customer’s time and money.”  These complaints allege, among other things, that Obé fails to notify consumers that their trial period will convert into a recurring subscription, forces consumers to cancel by phone during a limited range of hours, does not timely answer the phone number to which it directs consumers seeking to cancel, fails to act on consumer requests to cancel, and continues to charge consumers who are not using the service, all resulting in unwanted auto-renewing charges to consumers’ payment methods.
